Apply for a Taxi Business License
Service description
Under the provisions of the Passenger Transportation Act, a company must obtain a permit or license to operate a taxi and/or rental car business. In Hesse, cities and municipalities with more than 7,500 residents are responsible for issuing these permits; in other cases, the district administration is responsible.
To obtain such a license, a specific formal application must be submitted. Application forms are available upon request.
Procedure
- Submit an application to the appropriate transportation authority (cities and municipalities with more than 7,500 residents have their own authority; otherwise, the county transportation authority is responsible) and include all required documents with your application.
- The agency will process your application and conduct the necessary hearings.
- You will receive a notice regarding the issuance or renewal of a taxi permit, along with the delivery of the permit documents.
Prerequisites
- The safety and efficiency of operations are ensured.
- There is no evidence to suggest that the applicant, as a business owner, or the person appointed to manage the business, is unreliable.
- The applicant, as a business owner, or the person appointed to manage the business, is professionally qualified.
- The applicant and the contractors engaged by the applicant to provide transportation services must have their principal place of business or branch office, as defined by commercial law, within the country.
New applicants and existing business owners must be given appropriate consideration. Within each of these two groups, consideration is given in the order in which applications are submitted.
Regardless of when the application is submitted, the following will be given lower priority:- anyone who does not intend to operate a taxi business as their primary occupation,
- has not operated his or her taxi business as a primary occupation, or has sold or leased it, in whole or in part, within the last 8 years,
- has not properly fulfilled his or her duty to operate the vehicle
An applicant may be granted only one license at a time, unless the number of licenses available exceeds the number of applicants.
New applicants are granted a license valid for 2 years. During this period, the rights and obligations arising from the permit may not be transferred.
For legal entities under public law, the requirements are deemed to be met.What documents are required?
- Formal application (last name, first name of the applicant; residence and business address; for individuals: date of birth, place of birth; number of vehicles, vehicle type, capacity of the vehicles to be used)
- Certificates of employment or examination certificates (demonstrating professional qualifications) of the applicant or the person appointed to manage the business
- Certificate of Equity / Supplementary Certificate (form in accordance with Section 2(2)(2) / Section 2(3) of the Ordinance on Access to the Profession of Road Passenger Transport [PBZugV]), not older than 12 months
- Certificate of good standing issued by the tax office, the municipality, the social security agency, and the workers’ compensation association, not older than 3 months (from the company, its legal representative, and the person appointed to manage the business / traffic management)
- Certificate of Good Conduct for submission to the authorities pursuant to Section 30(5) of the BZRG
- Extract from the Central Trade Register pursuant to Section 150(5) of the Trade Regulation Act (GewO) (for businesses)
- Extract from the Driver Fitness Registry (FAER)
General Documents
- Vehicle list, including rental vehicles (if applicable) with rental agreements or a leasing list
- Proof of liability insurance for taxis, including the vehicle identification number (WKZ)
- Business Registration
- for partnerships, the list of partners, the partnership agreement, or other proof of authority to enter into contracts
- certified extract from the commercial register
The licensing authority may require additional information and documents, in particular a certificate of good conduct.
What deadlines do I have to observe?
Time limits do not begin to run until an application that is ready for a decision has been submitted. Once your application is complete, a decision will be made within 3 months. If necessary, the time limit may be extended by 3 months.
The extension of the three-month period may not exceed three months. The approval is deemed to have been granted if it is not denied within the specified period.
Processing time
Processing times may vary among the relevant transportation authorities. Processing times may depend, among other things, on whether all documents relevant to the decision have been submitted or whether additional documents will be required.
