Terms and Conditions for Using the Online Appointment Scheduling System

You can use the email reminder service provided by the Fulda District Waste Collection Association to receive email reminders about the pickup of the waste containers you have selected. The Waste Collection Association hereby commits to complying with the data protection provisions of the GDPR (General Data Protection Regulation).

When using the email reminder service, personal data is collected and processed to the extent necessary to provide the service. Personal data is data that can be used to identify an individual. This may include, for example, a person’s name, address, phone number, and email address.

Personal data is processed in accordance with the EU General Data Protection Regulation (hereinafter “GDPR”) based on your consent pursuant to Article 6(1), first sentence, subparagraph (a), and Article 7 of the GDPR.

You’ll see the “Reminder Email” link under the “Waste Management” / “Service” / “Waste Collection Calendar” section. If you follow the link, you will be directed to the registration page for the email reminder service, a product of CubeFour GmbH, Bgm.-Wohlfarth-Straße 72b, 86343 Königsbrunn. Based on the selected waste collection calendar (municipality + district), you can choose the desired reminder period and enter your email address. To verify that the registration is actually being performed by the owner of the email address, the “double opt-in” procedure is used. Only after a confirmation email has been sent and the response requested therein has been received will the email address be permanently stored there until you delete it yourself. The email address is used exclusively for sending the reminder email and is not shared with third parties.

You have the right to withdraw your consent at any time. However, withdrawing your consent does not affect the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

The data controller collects the following personal data solely for the purpose of the email reminder service:

The personal data collected is transmitted to CubeFour’s server for the purpose of the email reminder service. The data you enter is transmitted exclusively via the encrypted HTTPS protocol. A data processing agreement has been entered into with CubeFour.

You can unsubscribe from the service at any time by clicking the link included in each reminder email. Once the purpose has been fulfilled, the data will be deleted.

Gift market

You can use the giveaway marketplace operated by the Waste Collection Special-Purpose Association for the Fulda District to give away items you no longer need but that are still usable, instead of disposing of them or searching for such items. The Waste Collection Association is committed to complying with the data protection provisions of the GDPR.

When using the gift exchange marketplace, personal data is collected and processed to the extent necessary to provide the service. Personal data is data that can be used to identify an individual. This may include, for example, a person’s name, address, phone number, and email address.

Personal data is processed in accordance with the GDPR on the basis of your consent pursuant to Article 6(1), first sentence, subparagraph (a), and Article 7 of the GDPR, which you may revoke at any time with future effect.

Under the “Waste Management” / “Service” / “Giveaway Market” section, you will find the “Giveaway Market,” a product of CubeFour GmbH, Bgm.-Wohlfarth-Straße 72b, 86343 Königsbrunn. Under the "Waste Management" / "Service" / "Waste Navigator" section, you will find the "Waste Navigator," a product of CubeFour GmbH, Bgm.-Wohlfarth-Straße 72b, 86343 Königsbrunn.

Using the Waste Navigator provided by the Fulda District Waste Collection Association, you can find waste disposal facilities operated by the Association, the Dual Systems, the City of Fulda, and other providers in the Fulda district, sorted by category, or view them on a map. In addition to the location of each facility, you’ll find further information about the waste disposal facilities. The Fulda District Waste Collection Association is committed to complying with the data protection provisions of the GDPR.

When using the Waste Navigator, personal data is collected and processed to the extent necessary to provide the service. Personal data is data that can be used to identify a person. The voluntary use of OpenStreetMap is intended to ensure an appealing presentation of the Waste Navigator. Data is transferred to the United Kingdom in accordance with the EU Commission’s Adequacy Decision (see Art. 45 of the GDPR) dated June 28, 2021.

Online Bulky Waste Registration

You can schedule a bulky waste pickup using the online bulky waste registration system provided by the Waste Collection Association for the Fulda District. The Waste Collection Association is committed to complying with the data protection provisions of the GDPR.

When using the online bulky waste registration service, personal data is collected and processed to the extent necessary to provide the service. Personal data is data that can be used to identify an individual. This may include, for example, a person’s name, address, phone number, and email address.

The processing of personal data is carried out in accordance with the GDPR on the basis of Article 6(1), first sentence, subparagraph (c) of the GDPR in conjunction with Section 17 of the Hessian Implementation Act for the Circular Economy Act (HAKrWG).

Under the “Waste Management” / “Service” / “Bulky Waste Registration” section, you will find the “Online Bulky Waste Registration,” a product of c-trace GmbH, Bielitzer Str. 42, 33699 Bielefeld. In addition to the data processing required for general use, your contact information (name, address, email address, and phone number, if applicable) is required for the bulky waste registration. You must also provide details about the bulky waste items to be disposed of. This data is needed to organize and carry out the bulky waste pickup.

All authorized persons involved in the implementation and organization of waste disposal have access to the data. These include the waste collection company Knettenbrech + Gurdulic Service GmbH & Co. KG, located at Ferdinand-Knettenbrech-Weg 10a, 652025 Wiesbaden; the relevant cities and municipalities in the Fulda district; and the Fulda District Waste Collection Association.

The data controller collects the following personal data solely for the purpose of bulky waste collection:

• Name
• First Name
• Street
• Zip Code and City
• Email address
• Phone number
• Bulky items to be disposed of

The personal data collected is transmitted to the c-trace server for the purpose of carrying out bulky waste collection. The data entered is transmitted exclusively via the encrypted HTTPS protocol. A data processing agreement has been concluded with c-trace, Knettenbrech + Gurdulic, and the member municipalities of the Waste Collection Association.

Personal data will be stored only as long as necessary to fulfill the purpose, but for at least 1 year. This period is based on the right of every household connected to the collection system to schedule bulky waste pickups twice a year free of charge (Section 15(2) of the Waste Management Regulations for the Fulda District Waste Collection Association). Once the purpose has been fulfilled, the data will be deleted.

8. Locaboo

To make it easy and efficient to book municipal venues, we use the Locaboo service. The service is provided by Locaboo GmbH, Balanstr. 73 | Haus 12, 81541 Munich, Germany. Locaboo is an online platform that allows users to search for and book various venues.

Processing of Personal Data

Various types of personal data are processed when using Locaboo. This may include:

• Name
• Contact information (such as mailing address, email address, phone number)
• Booking details (such as date, time, and type of event)

This information is required to process booking requests, check the availability of facilities, and confirm the booking.

Purpose of Data Processing 

Your personal data is processed solely for the purpose of providing the booking service, managing your booking requests, and communicating with you regarding your bookings.

Legal basis

The processing of your personal data is based on Article 6(1)(b) of the GDPR, which permits the processing of data for the purpose of fulfilling a contract or taking precontractual measures at the request of the data subject. In this case, the data processing is necessary to conclude and fulfill the contract with you regarding the reservation of premises.

Data Transmission

In order to provide the booking service, it is necessary to transmit your data to Locaboo. Locaboo processes this data on behalf of the Fulda District in accordance with the requirements of the GDPR and in compliance with strict data protection standards. To ensure that data is processed in compliance with data protection regulations, we have entered into a data processing agreement with Locaboo.

9. ZendTo 

We use ZendTo to transfer large amounts of data. This open-source service was developed by Jules Field and is based on Doke Scott’s Perl UD Dropbox. ZendTo is not a “traditional” cloud service. The service, as well as all data, is operated, stored, and processed on the Fulda District’s own servers and managed by our own IT staff.

ZendTo also allows us to offer you an upload area on our website where you can upload content to make it available to employees of the Fulda District. When you upload content, your name and email address are collected and processed in addition to the uploaded content. The use of ZendTo is based on Art. 6(1), sentence 1, lit. e), and (2) and (3) of the GDPR in conjunction with § 3(1) of the HDSIG.

Security

All data transmitted over the network is encrypted. Access to the stored data is strictly monitored and logged by our IT staff to prevent unauthorized access to files by third parties. Confidential data can be encrypted before upload. The password used for this purpose is not stored on ZendTo and cannot be recovered if lost. Without the password, access to the data is not possible.

Retention period

Uploaded files are stored on ZendTo for a maximum of 7 days. After 7 days, the files are automatically deleted.

11. Job Openings and Applications

Handling of Applicant Data

We offer you the opportunity to apply for a position with us (e.g., by email, mail, or via our online application form). Below, we provide information about the scope, purpose, and use of your personal data collected as part of the application process. We assure you that the collection, processing, and use of your data are carried out in accordance with applicable data protection laws and all other legal requirements, and that your data will be treated with the strictest confidentiality.

Scope and Purpose of Data Collection

If you submit an application to us, we will process your associated personal data (e.g., contact and communication information, application documents, notes taken during job interviews, etc.) to the extent necessary to make a decision regarding the establishment of an employment relationship. The legal basis for this is Section 23 of the HDSIG under German law (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general pre-contractual processing), and—if you have provided consent—Article 6(1)(a) of the GDPR. You may withdraw your consent at any time. Within our agency, your personal data will be disclosed exclusively to individuals involved in processing your application. If your application is successful, the data you submitted will be stored in our data processing systems pursuant to § 23 HDSIG and Art. 6(1)(b) of the GDPR for the purpose of carrying out the employment relationship.

Data Retention Period

If we are unable to offer you a position, if you decline a job offer, or if you withdraw your application, we reserve the right to retain the data you have provided for up to 6 months from the end of the application process (rejection or withdrawal of the application) based on Art. 6(1)(e) GDPR in conjunction with § 23 HDSIG. The data will then be deleted and the physical application documents destroyed. This retention serves, in particular, as evidence in the event of a legal dispute. If it becomes apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), the data will not be deleted until the purpose for its continued retention no longer applies.

Data may also be retained for a longer period if you have provided the necessary consent (Article 6(1)(a) of the GDPR) or if statutory retention requirements prevent the data from being deleted.

Job Cluster

We post job openings on our website. To do this, we use a service provider that handles the design and content optimization of the job postings and integrates them into our website. The service provider is Jobcluster Deutschland GmbH, Fuldaer Strasse 13, 36124 Eichenzell (“Jobcluster”). When you access the job postings via the iFrame, your access data—such as your IP address, timestamp, and browser—is transmitted to Jobcluster. Jobcluster processes this data as part of a data processing agreement for the purpose of displaying job postings to prospective applicants that are updated daily and optimized in terms of both content and design.

Purpose and Legal Basis

The use of the Content Delivery Network is based on our legitimate interests, i.e., our interest in the secure and efficient provision of job postings, as well as the optimization of our online services and application process, in accordance with Article 6(e) of the GDPR in conjunction with Section 3(1) of the HDSIG.

Retention period

12. Automatic Translation with DeepL Pro 

The Fulda District would like to offer you the opportunity to read the content in other languages as well. To do this, we use the DeepL Pro translation service. DeepL SE is a third-party provider (DeepL SE, Maarweg 165, 50825 Cologne) that automatically translates the content. You can find this feature in the header. By clicking on the respective language, you will be taken to the pages that have already been translated into that language. No personal data is transmitted to DeepL.

We use the event software eveeno (https://eveeno.com/de/) to organize events. eveeno complies with the European General Data Protection Regulation (GDPR).

14. Bavarian Municipal Data Processing Agency (AKDB)

We provide information regarding the collection and processing of personal data by the Fulda District Motor Vehicle Registration Office and the Fulda District Office of Foreigners.

The processing activities cover the following areas of the Motor Vehicle Registration Office: registration, including the issuance of license plates; transfer of ownership; deregistration; and re-registration of vehicles for road use; Reviewing and issuing an official decision in cases of technical defects, failure to undergo mandatory inspections (HU or SP), pending sales notices, insurance claims, and outstanding taxes and fees.

You can use the online services “Residence Permits,” “Residence of EU and EEA Citizens and Their Families (Persons Entitled to Freedom of Movement),” and “Employment and Training for Holders of Temporary Residence Permits and Tolerance Permits” to apply for benefits at a Foreigners’ Registration Office.

We maintain publicly accessible profiles on social media platforms. You can find a list of the specific social media platforms we use below.

Social networks such as Facebook, X, etc., can generally analyze your user behavior in detail when you visit their website or a website with integrated social media content (e.g., “Like” buttons or advertising banners). Visiting our social media pages triggers numerous data processing operations relevant to data protection. Specifically:

If you are logged into your social media account and visit our social media page, the operator of the social media platform may associate this visit with your user account. However, your personal data may also be collected even if you are not logged in or do not have an account with the respective social media platform. Legal basis

Our social media accounts are intended to ensure the most comprehensive online presence possible. This constitutes a legitimate interest within the meaning of Article 6(1)(e) of the GDPR in conjunction with Section 3(1) of the HDSIG. The analysis processes initiated by the social networks may be based on different legal grounds, which must be specified by the operators of the social networks (e.g., consent within the meaning of Article 6(1)(a) of the GDPR).

Data Controller and Exercising Your Rights 

When you visit one of our social media pages (e.g., Facebook), we are jointly responsible with the operator of the social media platform for the data processing activities triggered by that visit. In general, you may exercise your rights (right of access, rectification, erasure, restriction of processing, data portability, and the right to lodge a complaint) both with us and with the operator of the respective social media platform (e.g., Facebook).

Please note that, despite our shared responsibility with the social media platform operators, we do not have full control over the data processing activities of these platforms. Our options depend largely on the corporate policies of the respective provider.

Retention period

Data collected directly by us through our social media presence will be deleted from our systems as soon as you request that we delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions—in particular retention periods—remain unaffected.
