At its meeting on November 25, 2024, the Assembly of the Special-Purpose Association for Waste Collection in the Fulda District adopted this 3rd Amendment to the Waste Management Bylaws of the Fulda District Waste Collection Special-Purpose Association dated December 15, 2015, including the 1st Amendment of November 22, 2022, and the 2nd Amendment of December 11, 2023. It is based on the following legal grounds:
The Special-Purpose Association Bylaws dated June 27, 2022, with
- Sections 7, 8, and 20 of the Act on Municipal Cooperation (KGG), as amended on December 16, 1969 (GVBl., p. 307), last amended by Article 7 of the Act of February 16, 2023 (GVBl. p. 83),
- Sections 5, 9, 19, 20, 51, and 93(1) of the Hessian Municipal Code (HGO), as amended on March 7, 2005 (GVBl. p. 142 et seq.), last amended by Article 2 of the Act of February 16, 2023 (GVBl. p. 90),
- Sections 17 and 20 of the Act on the Promotion of the Circular Economy and the Ensuring of Environmentally Sound Waste Management (Circular Economy Act — KrWG) in the version dated February 24, 2012 (Federal Law Gazette I, p. 212), last amended by Article 5 of the Act of March 2, 2023 (Federal Law Gazette 2023 I No. 56),
- Sections 1(6), 4, and 5 of the Hessian Implementation Act for the Circular Economy Act (HAKrWG), as amended on March 6, 2013 (GVBl., p. 80), last amended by Article 15 of the Act of May 3, 2018 (GVBl., p. 82),
- Sections 1–5a and 10 of the Law on Municipal Taxes (KAG), as amended on March 24, 2013 (GVBl., p. 134), last amended by Article 4 of the Act of July 20, 2023 (GVBl. p. 582),
- Sections 3 and 7 of the Ordinance on the Management of Commercial Municipal Waste and Certain Construction and Demolition Waste (Commercial Waste Ordinance — GewAbfV) in the version dated April 18, 2017 (Federal Law Gazette I, p. 896), last amended by Article 3 of the Regulation dated April 28, 2022 (Federal Law Gazette I, p. 700).
Article 1
Section 17(2)(a), first sentence, is amended to read as follows:
a) The basic fee component: The basic fee is 2.70 EUR per person per month.
Article 2
Section 17(2)(b), second sentence, is amended to read as follows:
The container fee for bi-weekly collection of the general waste and organic waste containers is
120-liter bin: 7.88 EUR/month;
240-liter bin: 15.76 EUR/month;
360-liter bin: 23.64 EUR/month;
660-liter bin: 43.32 EUR/month;
1.100-liter bin: 72.22 EUR/month.
Article 3
Section 17(2)(c), first sentence, is amended to read as follows:
For general waste bins that are collected every four weeks in accordance with Section 14, paragraph 1, the bin fee for a
120-liter bin: 3.94 EUR/month
; 240-liter bin: 7.88 EUR/month;
360-liter bin: 11.82 EUR/month;
660-liter bin: 21.66 EUR/month
. 1.100-liter bin for 36.11 EUR/month.
Article 4
Section 17, paragraph 3, sentence 2, is amended to read as follows:
The fee includes a pro-rata share of the base and container fees and, for a 14-day collection cycle of the residual waste and organic waste containers, amounts to
120-liter bin: 18.86 EUR/month
; 240-liter bin: 34.66
EUR/month; 360-liter bin: 50.64
EUR/month; 660-liter bin: 94.63
EUR/month; 1.100-liter bin: 158.62
EUR/month; 1,100-liter bin (on demand): 79.31 EUR/empty.
Article 5
Section 17, paragraph 5, is amended to read as follows:
70-liter trash bags for temporary increases in general waste are sold at a unit price of 3.00 EUR. This fee also includes the cost of disposal.
Article 6
Section 17, paragraph 6, is amended to read as follows:
The fee for emptying an improperly filled organic waste or paper recycling bin as part of the residual waste collection, pursuant to Section 11, paragraph 9, is
120-liter container: 20.00 EUR;
240-liter container: 25.00
EUR; 1,100-liter container: 79.31 EUR.
Article 7
Section 17, paragraph 7, is amended to read as follows:
The fee for using the recycling centers
is for recyclable mineral materials (construction debris)
- up to 50 liters 3.00 EUR
- Between 50 liters and 250 liters: 10.00 EUR
- From 250 liters to 0.5 cubic meters: 20.00 EUR
for non-recyclable construction waste
- up to 50 liters 5.00 EUR
- Between 50 liters and 250 liters: 15.00 EUR
- From 250 liters to 0.5 cubic meters: 30.00 EUR
for waste wood as defined in the Waste Wood Regulation
- up to 50 liters 2.00 EUR
- Between 50 liters and 250 liters: 6.00 EUR
- From 250 liters to 0.5 cubic meters: 12.00 EUR.
Article 8
This amendment will take effect on January 1, 2025.
