Special case assessment according to the Recreational Noise Directive

For rare outdoor events, the provisions of the Federal Immission Control Act
sometimes not be met despite all technical and organizational noise reduction measures.

For rare Vevents that are highly location-specific or socially relevant and
acceptance , a so-called special-case assessment may be conducted in accordance with the Recreational Noise Directive
. This assessment may conclude that such an event
may neverthelesstake place.

A high degree of location-specificity is indicated when there is a particular local or regional connection
. In this sense, major events such as
Hessentag, Kieler Woche, and, in some places, even individual concerts in prominent
city center locations. This category also includes festivals of local significance – such as the
local fair or the annual fire department festival - as well as special club celebrations (e.g.,
model vehicle championships).

Social appropriateness andacceptance can be assumed if the event has a social
function and significance. Examples of socially appropriate events include locally unique
youth festivals, such as the Wiesbaden Folklore Festival. An example of a socially accepted event is
the “Carnival of Cultures,” which is at least tolerated by athe majority of local residents—at least tolerated—Carnival of Cultures in
Berlin.
