License for a security business pursuant to Section 34a of the Trade Regulation Act

You must submit your application for a permit under § 34a of the Trade Regulation Act (GewO) to the Public Order Department of the Fulda District.

For legal entities, you need only complete the application form for the legal entity itself. You must submit all personal documents for all natural persons authorized to manage the business.

Partnerships are not eligible for a license as such. Therefore, each managing partner must obtain a license. For each of these individuals, you must submit a separately completed application form and all required personal documents.

The requirements for obtaining a license under § 34a of the Trade Regulation Act (GewO) are: your good character, registration with the Chamber of Industry and Commerce (IHK), sufficient funds or collateral for your business, and proof of liability insurance (in accordance with the Security Services Ordinance).

A security contractor may be a natural person or a legal entity. In the case of partnerships, each managing partner is considered a business operator. In the case of legal entities, the license is issued to the legal entity itself.

If you have not resided in Germany or the EU during the past 3 years and your “reliability” therefore cannot be adequately verified, you will not be able to obtain a permit.

The fee for issuing a permit varies depending on the individual case and ranges from 330.00 euros to 1,850.00 euros.
