Facilities on Surface Water Bodies

Facilities located in or along bodies of water, as well as projects that cross a body of water—whether above or below ground—require a permit under water law. This also applies to significant modifications to existing facilities.

Structures in and along waterways include, for example, culverts, bridges, weirs, shoreline developments, and docks. The term “waterway crossings” refers to situations where cables, utility lines, or waste disposal lines cross a waterway above or below the water surface.

Applications may be submitted informally—usually through the local municipality—along with a detailed description of the project and the accompanying planning documents.
