Privacy Notice from the Fulda Public Health Department in accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR) regarding the dental screening programs conducted by the Dental Service at daycare centers in the city and district of Fulda

Legal Basis for Screening Programs

The provision of dental examinations in daycare centers is mandated by Book V of the Social Code (§ 21 SGB V) and the Hessian Law on Public Health Services (§§ 10, 11 HGöGD).

These screening programs involve the collection of data, which we handle responsibly and in compliance with the provisions of the General Data Protection Regulation (GDPR).

Legal Basis for Data Collection

• Hesse Public Health Service Act (Sections 10, 11, 18, 22 HGöGD)
• Hesse Data Protection and Freedom of Information Act (HDSIG)
• General Data Protection Regulation (Art. 6, paras. 1(a) and 1(e) of the GDPR)

Categories of Data

We collect the following data: name, address, date of birth, gender, nationality, information about the daycare center, and dental and oral health findings. This data is processed anonymously for statistical purposes.

Purpose of Data Processing

Personal data is processed for the following purpose:

• Dental checkups for all children ages three to six in daycare centers

For statistical analysis, the health data is anonymized and is used to:

• health promotion and preventive health efforts through public education
• Epidemiological surveys and analyses for health reporting to inform decision-making regarding measures at the local level

Recipients or Categories of Recipients of the Data

No data is transferred to third parties.

Duration of Data Retention

The data will be retained in accordance with legally prescribed retention periods until the individual reaches the age of 23, at which point it will be deleted.

Rights of Affected Individuals

The legal basis for data processing is the General Data Protection Regulation; the rights of data subjects are set forth in particular in:

• Right of Access (Art. 15 of the GDPR, § 33 of the HDSIG)
• Right to Rectification (Art. 16 of the GDPR)
• Right to Erasure (Art. 17 GDPR, § 34 HDSIG)
• Right to restriction of processing (Art. 18 GDPR, § 34 HDSIG);
  under the HDSIG, this right replaces the right to erasure in certain cases
• Right to Object (Art. 21 GDPR, § 35 HDSIG)
• Right to Withdraw Consent (Art. 7(3) of the GDPR)
