Mandatory Consumer Information

Section 40(1a) of the Food, Consumer Goods, and Animal Feed Code (LFGB) requires the competent authorities to immediately inform the public, naming the responsible company, about

1. Exceedances of established limits, maximum levels, and maximum quantities in food or feed,
2. the presence of an unauthorized or prohibited substance in the food or feed, or
3. all other violations of hygiene regulations or regulations designed to protect public health—or to prevent deception—if they occur to a significant extent or repeatedly and are likely to result in a fine of more than 350 euros or a penalty for a criminal offense, and for which a referral has therefore been made to the public prosecutor’s office pursuant to § 41 of the Administrative Offenses Act,

notify the affected company without delay after hearing its side of the story. The publication must be removed after six months.
