Applying for planning permission for the construction of an installation using the simplified procedure
Service description
The simplified procedure applies to all construction projects that are not special structures, are not exempt from building permits, and are not subject to any exemption from permitting requirements.
For construction projects that are exempt from requiring a permit, the municipality may declare that a simplified building permit procedure is to be carried out. In the case of exemptions, this is determined by the lower building authority. The building owner may also request that the simplified building permit procedure be carried out.
Unlike in the full permitting process, the scope of the building authority’s review is significantly reduced in the simplified building permit process.
The subject of the examination is
- the project's compliance with building codes
- Requested deviations, exceptions, or exemptions
- other provisions of public law, to the extent that a decision under such provisions is waived or superseded by the building permit
The building owner is responsible for ensuring compliance with public law regulations that are not reviewed as part of the simplified building permit process. In individual cases, a separate application must be filed for a deviation, exception, or exemption from public law regulations that are not subject to review. In the event of a violation of these regulations, the building permit authority may halt construction or order the demolition of structures that have already been built.
The building permit expires if you do not begin construction within 5 years of the permit being issued, or if construction has been suspended for more than 2 years after that period.
Procedure
- You can fill out the application online via the building portal or on paper and submit it, along with the required documents, to the appropriate building authority.
- The building authority will review your application and the supporting documents.
- If all requirements are met, the permit will be granted.

What fees apply?
The amount of the fees is based on the cost of the building’s shell. Local municipalities may, by ordinance, set fees that differ from those listed in the fee schedule of the Administrative Costs Regulation. Please contact the building inspection authority responsible for your area for more information.
What deadlines do I have to observe?
Special information for the Fulda districtThe duration of the procedure depends on the individual case, particularly on which agencies must be involved. As a rule, the procedure takes a maximum of 3 months from the date the application is submitted in full. The procedure may be extended by 2 months only if special circumstances exist. The application is deemed approved if no decision has been made within this period.

Legal remedy
An appeal may be filed against the agency's decision within one month of its notification.

What else should I know?
Fuel-burning systems may not be put into operation until an expert in energy-generating systems (such as an authorized chimney sweep) has certified that they are safe to use and that exhaust gases are being properly vented.
