Screening Examinations Conducted by the School Dental Service

The conduct of dental examinations in schools is enshrined in Book V of the Social Code (§ 21 SGB V) and in the Hessian Law on Public Health Services (Sections 10, 11 HGöGD) and is further defined in the Ordinance on the Authorization and Organization of Examinations and Measures in School Health Care (SchulGesPflV HE).

These screening programs involve the collection of data, which we handle responsibly and in compliance with the provisions of the General Data Protection Regulation (GDPR).

• Hesse Public Health Service Act (Sections 10, 11, 18, 22 HGöGD)
• Regulation on the Approval and Organization of Examinations and Measures in School Health Care
• Hesse School Act (Sections 71, 141 HSchG)
• Hesse Data Protection and Freedom of Information Act (HDSIG)
• GDPR (Art. 6, paras. 1(c) and 1(e))

Categories of Data

We collect the following data: name, address, date of birth, gender, nationality, school information, and dental and oral findings. The data is processed anonymously.

Purpose of Data Processing

Personal data is processed for the following purposes:

• School dental examinations for all children in elementary and special education schools
• Implementation of group-based preventive care in all elementary and special education schools

For statistical analysis, the health data is anonymized and is used to:

• Health Promotion and Prevention Efforts Through Public Education
• Epidemiological surveys and analyses for health reporting to inform decision-making regarding measures at the local level

Recipients or Categories of Recipients of the Data

No data is transferred to third parties

Duration of Data Retention

The collected data will be retained in accordance with legally prescribed retention periods until the individual reaches the age of 23, at which point it will be deleted.

Rights of Affected Individuals

The legal basis for data processing is the General Data Protection Regulation; the rights of data subjects are set forth in particular in:

• Right of Access (Art. 15 of the GDPR, § 33 of the HDSIG)
• Right to Rectification (Art. 16 of the GDPR)
• Right to Erasure (Art. 17 GDPR, § 34 HDSIG)
• Right to restriction of processing (Art. 18 GDPR, § 34 HDSIG);
• Under the HDSIG, this right replaces the right to erasure in certain cases,
• Right to Object (Art. 21 GDPR, § 35 HDSIG)
